Institutional Policy

INTELLECTUAL PROPERTY

It is the policy of the Medical College of Wisconsin Affiliated Hospitals that all intellectual property created by the housestaff during the course of their residency or fellowship training be reported and assigned to the MCW Research Foundation, Inc., a not-for-profit Wisconsin Corporation organized for educational and charitable purposes. Examples of intellectual property covered by this policy are any inventions, discoveries or writings that may be the subject of patent, trade secret, copyright or trademark protection. Housestaff who create intellectual property participate with the MCW Research Foundation in any income that might be obtained in the licensing or sale of such property. If the Foundation elects not to pursue protection of this intellectual property, then the rights to that property shall be returned to the creator to use as he or she sees fit. An exception to this policy is intellectual property that is both unrelated to the housestaff member's training program and created without use of MCWAH or the Medical College of Wisconsin resources or personnel; MCWAH or the MCW Research Foundation does not claim ownership of this intellectual property.

This policy was approved by the MCWAH Graduate Medical Education Council on August 16, 1999.
